Terms and Conditions

By signing up and actively using Funcent you agree to all terms and conditions set forth in this agreement. Funcent may, at any time, choose to edit, add and/or delete portions of this agreement and impose changes without prior notification of its members. Members will be informed of any and all changes to this policy via an email to their primary contact email address provided upon signing up with us. If any modification is unacceptable to you, your only recourse is to terminate this agreement. Your continued participation in this program following our posting of a change in policy notice or new agreement on our site will constitute binding acceptance to the change.

Responsibility of Members

You must be 13 years of age or older. Minors must have parental consent to participate in this program. Our program is open to both US and International members and is void where prohibited by local governing laws. You agree to and must use your own name and email address in the sign-up process and may not assume a false identity. You may not signup multiple times with different email addresses. Your computer must not be shared with another individual that has an existing account. You will use your username / password combination to access your account, it is your responsibility to keep this information confidential, you may change this information by logging into your account and pressing the change information link. You are solely responsible for any and all use of your account including authorization by you to any third party individual who may use your account. Should any instances of fraud, system abuse, or any type of activity deemed to be inappropriate or illegal by us be detected it may result in member termination and possible legal action.

Relationship of the Parties

You and Funcent are independent contractors, and nothing in this Agreement creates any partnership, joint venture, agency, franchise, sales representative or employment relationship between you and Funcent. You understand that you do not have authority to make or accept any offers or make any representations on behalf of Funcent. You may not make any statement, whether on your site or otherwise, that would contradict anything in this section.

Limitation of Liability

Funcent will not be liable for lost profits, lost business opportunities, or any other indirect, special, punitive, incidental or consequential damages arising out of or related to this Agreement or Funcent, even if Funcent has been advised of the possibility of such damages. Furthermore, Funcent aggregate liability arising under this Agreement will not exceed the amount of the total fees paid or payable to you under this Agreement. The provisions of this Section survive termination or expiration of the Agreement.

Usage Policy

We only accept traffic from United States, Canada, Austria, Belgium, Denmark, Finland, France, Germany, Greece, Ireland, Italy, Netherlands, Portugal, Spain, Sweden, and United Kingdom. Affiliate agrees that traffic not from the above nations and regions will not be paid for. Your site must be written in English. We do not allow Adult Sites and Illegal Sites like MP3, etc. Any websites that offers rewards in any form to users for clicking on links or visiting websites are not eligible to join our programs. We do not allow use of Free Proxy Servers by affiliates to earn quick credit. We only pay for 2 clicks from an IP address and for different keywords in 24 Hrs. We do not allow use of Fixed key words in the Search Box. If a user clicks on all or unreasonable amount of the search result to make quick credit they will be counted as Invalid Click and it may result in member termination and possible legal action.

Compensation

Share our 65% of revenue for each unique search and click on the search result from your site by text link or search box. We only pay for 2 clicks from an IP address and for different keywords in 24 Hrs. You will also get 10% from your direct referrals' earning. You can cashout by Paypal or e-Gold (with 10% fee). The minimum payout rate is $5. Payments will be made within 45 days of the last month you earned.

Spam

You may not promote your affiliate links through unsolicited emailing (i.e. SPAMMING), newsgroup postings, or any other method of mass communication. Failure to comply will result in immediate termination of your membership with Funcent and may result in legal prosecution. Funcent strictly enforces anti-spamming laws. Spamming is a federal crime. Any member caught spamming will not only have their account terminated immediately and lose any past, present and future earnings, but shall also be held liable for Spamming as we shall cooperate with any authorities and investigations that may arise from the Spamming incident.

Privacy Statement

Funcent has created this privacy statement in order to demonstrate our firm commitment to privacy. Funcent uses your IP address to help diagnose problems with our server, and to administer our Web site. Your IP address is used to gather broad demographic information. Funcent uses cookies to deliver content specific to visitors' interests, to save your password so you don't have to re-enter it each time you visit our site, and for other purposes. Funcent registration form requires users to give us contact information (like their name, address, and email address). This site contains links to other sites. Funcent is not responsible for the privacy practices or the content of such Web sites. Funcent uses a signup form for new members. We collect member's contact information (like their email address, address, and name). The member's contact information is used to get in touch with the member when necessary.

Security

Funcent has security measures in place to protect the loss, misuse and alteration of the information under our control.

Modifications

Funcent reserves all rights and may modify the terms of this Agreement without prior notice.
